An anti-Israel activist facing deportation is at the center of court proceedings.
A federal appeals court has ruled that a lower court lacked the authority to order the release of Mohsen Mahdawi, an individual arrested during a naturalization interview. The anti-Israel activist faces the possibility of deportation following his involvement in pro-Hamas demonstrations.
The Court of Appeals for the 2nd Circuit determined that Vermont District Judge Geoffrey Crawford did not have the authority to order Mahdawi’s release on bond two weeks after the initial arrest. Circuit Judge Debra Ann Livingston wrote the majority determination that the district court got involved too soon.
Mahdawi has now appealed the final removal order to the First Circuit U.S. Court of Appeals.
“It is a privilege to be granted a visa or green card to live and study in the United States of America,” a Department of Homeland Security spokesperson said. “When you advocate for violence, glorify and support terrorists that relish the killing of Americans, and harass Jews, that privilege should be revoked, and you should not be in this country.”
